INTRODUCTION

Advanced Medical Pricing Solutions (AMPS) respects your privacy. We have prepared this Privacy Policy (“Policy”) to explain how we collect, use, and disclose the personal information we collect: (i) through our website, www.amps.com, and any other website that posts this policy (the “Websites”), (ii) through our mobile app (the “App”), and (iii) otherwise in the course of providing our services (together with the Websites and App, the “Services”). 

Please note that this Policy does not apply to the protected health information (PHI) we collect in the course of providing our services. PHI is processed in accordance with our obligations under the Health Insurance Portability and Accountability Act (HIPAA) and our Business Associate Agreements.  PHI may include information about an individual’s past, present, or future health or condition, the provision of health care, and information regarding payment for the provision of healthcare including claims information. 

INFORMATION COLLECTION

In this Policy, the term "personal information," refers to information that identifies, relates to, describes or can reasonably be associated with an individual. The information we collect about you may vary depending on your relationship with us. We may collect the following types of personal information from individuals: first name, last name, address, email address, telephone number, IP address, username, password, and provider NPIs. The personal information we collect may pertain to the individual personally or may be their business contact information.

From job applicants, we may also collect information regarding their education and employment history.

We collect personal information directly from you or from third parties.   As discussed in the following section, we also automatically collect information regarding your activity on our Websites and App (some of which may constitute personal information).

COOKIES AND TRACKING TECHNOLOGIES

A cookie is a small text file that is stored on your browser or the hard drive of your computer. We—and our third party partners and service providers (such as advertising networks, analytics providers and social media platforms and networks)—use cookies and similar technologies such as tracking pixels and web beacons to collect user activity information including IP address (which is often considered personal information), geolocation data, browser and device characteristics, operating system, language preferences, referring URLs, information about how and when you use the Websites or App, and other technical details. We may use the following types of cookies:

  • Necessary cookies. These are cookies that are required for the operation of the Websites or App.
  • Functionality cookies. These cookies remember choices you make and are used to recognize you when you return to the Websites or App. 
  • Analytics cookies. These cookies collect information about how you use the Websites or App. They allow us to recognize and count the number of visitors and to see how visitors move around within the Websites or App.

Most web browsers automatically accept cookies, but you can modify your browser settings to decline cookies if you prefer. If you use your browser settings to block all cookies, you may not be able to access all or parts of our Websites. Some internet browsers have “Do Not Track” or “DNT” features which, when turned on, send a signal to the website that the individual visiting the website does not wish to be tracked. Our Websites do not honor DNT signals, but you can adjust your cookies settings as described.

INFORMATION USE

We use the information we collect, including personal information, for the following purposes:

  • To provide you with our Website, App, and Services
  • To create and manage your account
  • To provide customer support
  • To communicate with you and respond to your inquiries
  • To provide information you have requested
  • To provide information, newsletters, or advertisements that may be of interest to you
  • To solicit feedback and survey responses
  • To administer, personalize, and improve our Website, App, and Services
  • To develop new features and services
  • To generate statistics and de-identified data
  • To prevent, detect or fight fraud or illegal activities
  • To comply with legal requirements
  • For any other purpose with your consent

INFORMATION DISCLOSURE

In the following circumstances, we may share personal information with third parties:

  • Disclosures to Service Providers: To assist us in providing our Services, we may share personal information with vendors or service providers, such as providers of hosting services, cloud services, email solutions, data analytics services, advertising services, or support and maintenance services. We do not “sell” personal information as that term is traditionally defined, but our use of third party analytics and advertising service providers may constitute a sharing for cross-context behavioral advertising under state laws. 
  • Disclosures to Business Partners. We may share personal information with our business partners such as third party administrators (TPAs), brokers, and health plans.
  • Disclosures to Affiliates: AMPS entities may share personal information within the corporate family, meaning between our subsidiaries and affiliates.
  • Business Transfers: If we are involved in a merger, acquisition, or other corporate transaction, we may share your personal information during the diligence process with counterparties and others assisting with the transaction, as well as to a successor as part of such a transaction.
  • Legal Requirements: We may also share personal information if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, including to cooperate with law enforcement, (ii) protect and defend our rights or property, (iii) prevent fraud, (iv) act in urgent circumstances to protect the personal safety of users, or the public, or (v) protect against legal liability.
  • Consent: We may also share your personal information to other third parties not described above if we receive your consent to do so. 

DATA SECURITY

We use reasonable administrative, technical, and physical safeguards designed to ensure that the personal information we collect is protected from accidental or intentional manipulation, loss, destruction, or access by unauthorized persons. The transmission of information via the Internet, however, is not guaranteed to be completely secure. 

DATA RETENTION

We retain information as long as necessary to fulfill the purposes for which we collected it, for legitimate business reasons, or as required by law. We may need to keep your data for longer than our specified retention periods to honor your requests, including to continue keeping you opted out of marketing emails, or to comply with legal or other obligations. When we dispose of information, we use reasonably secure means, such as either physically or electronically erasing information or making it anonymous in a non-recoverable manner.

INTERNATIONAL TRANSFERS

AMPS is located in the United States. By submitting your personal information to us, you agree to the transfer, storage, and processing of your personal information in a country other than your country of residence including, but not limited to, the U.S. The personal information protection laws of other countries might be different from the laws of the jurisdiction in which you reside.

LINKS TO OTHER WEBSITES

For practical reasons or for your information, our Websites contain links to other websites, such as links to our profile pages on social media websites. We exercise no control over such other websites and are not responsible for the content thereon. This Privacy Policy does not apply to third party websites, and we recommend that you review the online privacy policy of any website you visit to determine how the operator handles personal information collected through its website.

CHILDREN’S PRIVACY

Our Websites, App, and Services are not intended for use by children under 18 years of age and we do not knowingly collect personal information from children under 18. If we learn we have inadvertently collected personal information from children under 18 years old, we will take steps to delete that information. 

YOUR PRIVACY CHOICES

Marketing Emails. You may opt-out of receiving promotional or marketing emails from AMPS at any time by using the “unsubscribe” link in the email you receive. Please note that we reserve the right to continue to send you other non-marketing communications related to your relationship with us.

Mobile App Device Permissions and Alerts. You may adjust your App access, permissions, and alerts through your mobile device’s settings menu. 

YOUR PRIVACY RIGHTS

Depending on your jurisdiction of residence, you may have the privacy rights listed below with respect to the personal information we collect about you. Please note that these rights are not absolute, may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law. 

  1. Right to Confirm / Access / Know. You may have the right to request access to personal information that we hold about you, including details relating to the ways in which we use and share your information. Residents of California have the right to know the categories of personal information we have collected about them, the categories of sources from which the personal information is collected, the categories of personal information sold, shared, or disclosed, the business or commercial purpose for selling, sharing, or disclosing the personal information, and the categories of third parties to whom we have sold, shared, or disclosed their personal information. 
  2. Right to Delete. You may have the right to request that we delete personal information we maintain about you.
  3. Right to Correct. You may have the right to request that we correct inaccurate personal information we maintain about you.
  4. Right of Portability. You may have the right to receive a copy of the personal information we hold about you and to request that we transfer it to a third party, in certain circumstances and with certain exceptions.
  5. Right to Withdraw Consent to Processing of Sensitive Personal Information. You may have the right to withdraw your consent to the collection, use and disclosure of your sensitive personal information, unless legal or contractual reasons prevent you from doing so. 
  6. Right to Opt-Out. You may have the right to opt-out of certain uses of your personal information such as for (i) targeted advertising, (ii) “sale” or “sharing” for cross-context behavioral advertising, or (iii) profiling or automated decision-making activities that result in a legal or similarly significant effect on you. 
  7. Right to Appeal. You may have a right to appeal our decision if we decline to process your request in part or in full. You can do so by replying directly to our denial. If you are not satisfied with our response to your appeal, you may contact your state Attorney General.

Requests to exercise these rights may be made using the contact information listed below, or as otherwise described above. Only you, or as permitted by law, a person that you authorize to act on your behalf, may make a request related to your personal information. For certain requests, we must verify your request before we can fulfill it. Verifying your request will require you to provide sufficient information for us to reasonably verify that you are the person about whom we collected personal information or that the requestor is authorized to act on your behalf. We will not discriminate against you for exercising your privacy rights.

ADDITIONAL DISCLOSURES FOR CALIFORNIA RESIDENTS

In addition to offering certain consumer rights (set forth in the section above), California law requires us to make the following additional disclosures to California residents regarding our information practices. As discussed above, please note that our collection, use, and disclosure of PHI is not addressed in this Policy. 

In the last twelve (12) months, the personal information AMPS has collected falls into the following categories of personal information as defined under California law:

  1. Identifiers and personal information categories listed in the California Customer Records statute, such as name, signature, address, phone number, email address, online identifier, unique identifier, IP address, date of birth, employment history, payment card data, medical information and health insurance information. We collect this category of information directly from you, automatically from your use of the Websites, from our business partners, and from job applicants. 
  2. Protected classification characteristics, such as age, race, color, ancestry, national origin, citizenship, and veteran or military status. We collect this category of information from job applicants. 
  3. Commercial information, such as records of products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies. We collect this category of information directly from you, automatically from your use of the Websites, and from our business partners. 
  4. Internet or other similar network activity, such as browsing history, search history, information on a consumer's interaction with a website, application, or advertisement. We collect this category of information automatically from your use of the Websites.
  5. Geolocation data, such as device location. We collect this category of information directly from information you provide and automatically from your use of the Websites.
  6. Sensory data, such as recordings of customer service calls. We collect this category of information automatically.
  7. Professional or employment-related information, such as current or past job history. We collect this category of information from job applicants.
  8. Non-public education information, such as transcripts. We collect this category of information from job applicants.
  9. Inferences drawn from other personal information, such as a profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes. We create this category of information based on other information we collect. 
  10. Sensitive personal information, such as username and password and precise geolocation. To the extent we collect sensitive personal information, we do not use it to infer characteristics about individuals. 

AMPS uses and discloses this personal information as described in the “Information Use” and “Information Disclosure” sections above. In the past 12 months, we have disclosed each of the above categories of personal information to our service providers, and we have disclosed the following categories to third party business partners for purpose of providing our Services: Identifiers and personal information categories listed in the California Customer Records statute.

AMPS does not sell personal information or share personal information for cross-context behavioral advertising under California law. 

CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. If we make updates, we will post the revised Policy on the Websites, update the "Last updated" date, and take any other steps required by applicable law.
